Merger Review in the 2020s: the Challenges of Digitalization, Globalization, and the Evolution of Merger Analysis

The International Competition Network (ICN) Annual Conference Merger Working Group Plenary explored the evolution of Merger Review in the 2020s. Digitalization and globalization are two major influencers on the evolution of competition policy. The panel discussion explored the following:

  • What are the characteristics of mergers in the digital economy?
  • Is merger review in the digital economy different and what are the challenges?
  • Does globalization influence market definition and competition analysis?
  • How can international cooperation help agencies to address multijurisdictional merger review?
  • How should agencies and parties deal with coordination of extraterritorial remedies? Is ex-post evaluation of merger decisions a useful diagnostic tool?
